Terms of Service
These terms cover your use of RigInk, a service for sending documents and collecting electronic signatures. By creating an account or signing a document you agree to them. RigInk is in a free beta; we will update these terms before paid plans start and tell account owners by email.
1. What RigInk does
RigInk lets a company (the "sender") send documents to people (the "signers"). Signers review, fill in and sign the documents online. RigInk records each step in an audit trail, seals the finished PDF so changes can be detected, and emails a copy to every party.
2. Electronic signatures
Electronic signatures and records made through RigInk are intended to be valid under the U.S. Electronic Signatures in Global and National Commerce Act (ESIGN, 15 U.S.C. 7001 and following) and the Uniform Electronic Transactions Act (UETA) as adopted by the states. Before signing, each signer must agree to use electronic records, and each signature is tied to a clear statement of intent to sign.
3. Sender responsibilities
- You must have the right to send each document and to ask each signer to sign it.
- You must not use RigInk for documents that the law requires on paper. Under ESIGN (15 U.S.C. 7003) these include wills, codicils and testamentary trusts; adoption, divorce and other family-law matters; court orders and official court documents; notices of utility shut-off; notices of default, foreclosure, eviction or repossession of a primary residence; cancellation of health or life insurance; product recall notices; and documents required to accompany hazardous materials.
- You choose how signers are identified. We recommend the email code option for every signer.
- You must give a signer a paper copy if they ask for one, free of charge, and you must honor a signer's withdrawal of consent.
- You are responsible for the content of your documents and templates. RigInk's library templates are starting points, not legal advice.
4. Records
We keep each completed document, its audit trail and its certificate of completion for the retention period set on the template (at least 3 years by default), so the record stays accurate and can be reproduced later. Every signer can download the sealed copy from their signing link during that time, and receives it by email when everyone has signed.
5. Acceptable use
Do not use RigInk to send spam, deceive people, impersonate anyone, or break the law. We may suspend accounts that do.
6. Not legal advice
RigInk is software, not a law firm. Nothing in the service is legal advice. If you are unsure whether a document can be signed electronically, ask a lawyer.
7. Beta service
During the beta the service is provided "as is", without warranties, and may change. To the extent the law allows, RigInk is not liable for indirect or consequential losses, and our total liability is limited to the amount you paid us in the last 12 months.
